These Terms of Use govern the use of the iDay User Platform accessible at the following URL address: ccsi-iday.com.
They shall apply between:
NEXENTURE, a private limited company with share capital of € 165,000, registered with the Lyon Trade and Companies Register under number 511 361 479, whose registered office is located at 21 rue Longue 69001 Lyon, represented by Mr Maxime VIGNON, In his capacity as CEO, on the one hand;
And
The User, on the other hand;
Hereinafter jointly referred to as the "Parties".
GCU: means this contract
iDay: denotes the event proposed by NEXENTURE.
Ideas: refers to the user's ideas on the User Platform as part of iDay.
Platform Users: refers to the software platform accessible remotely by the User as part of the iDay.
The User declares that he / she has taken cognizance and has expressly and unconditionally accepted the GCU in force on the date of access to the User Platform.
In the event that the User refuses all or part of the UGC, he waives any use of the User Platform.
NEXENTURE reserves the right to modify, at any time, all or part of the GCU. It is therefore up to the User to consult regularly the GCU accessible at the following address: ccsi-iday.com/legal.
Any use of the User Platform after modification of the UGC constitutes acceptance by the User of the new UGC.
The User expressly acknowledges that the use of the User Platform takes place within the framework of the missions provided for in his employment contract.
The use of the User Platform constitutes acceptance of the contest rules set out in Appendix 1 of the GCU.
The User declares to be aware and acknowledges that:
Access to the User Platform is made at the following address ccsi-iday.com, each personal connection requires the information of an identifier and a password assigned in the conditions defined in article 4 of the GCU.
The User Platform contains the following topics: welcome, post an idea, my ideas, ideas that I support, a search engine, accessible through the menu bar at the top of the screen.
The User Platform allows you to do the following: post an idea, read others' ideas, support them, comment on them, follow their ideas in terms of support and comments, follow the progress of the ideas that I support . An idea is anonymous vis-à-vis other employees as long as it has not received at least 10 supporters. It is possible to comment on an idea if and only if it has been supported beforehand.
It is possible to edit an idea until the end of the "pre-publishing" (18/12/13 上午12:00).
NEXENTURE does not guarantee the accessibility and operation of the User Platform.
The User acknowledges that the use of the User Platform takes place at his own risk and in particular with regard to the operation and security of his computer system. NEXENTURE shall not be liable for any defect or malfunction of the User Platform and the Internet connection.
By using the User Platform, User agrees not to:
The User agrees to compensate NEXENTURE for any direct and indirect damage related to the use of the User Platform.
The User will have a personal identifier and password, assigned as follows: Par nom / prénom / date de naissance.
The User is solely responsible for the use of the identifiers and solely responsible for the custody of these elements.
The User undertakes to use these elements only for his own account.
He also undertakes to keep them confidential and not to communicate them to anyone. The User therefore undertakes, in particular, not to leave a computer with an open session unattended.
The User also agrees not to access or attempt to access any account other than his own.
NEXENTURE grants to the User a personal, non-exclusive, non-transferable and non-transferable right to access and use the User Platform for the duration of iDay, and for the whole world, via its username.
The User agrees to use the User Platform only for his own purposes, in accordance with his destination and the GCU.
The right to use means the right to represent and implement the User Platform for the exclusive needs of the realization of iDay, in SaaS mode, via a connection to an electronic communications network. The right of use described above can only be implemented by the User for internal use.
The general structure of the User Platform, as well as the texts, graphics, images, sounds and videos composing it, are the property of NEXENTURE or its partners. No reproduction, even partial, may be made of the User Platform without the express prior authorization of NEXENTURE.
By accepting the Terms of Use, the User of the User Platform undertakes not to infringe, directly, indirectly or through third parties to which it would be associated with the intellectual property rights of NEXENTURE.
The User may not, therefore, copy, modify, in particular by decompiling, disassembling, merging into another software or determinant or in any other way, the source code or the underlying ideas, algorithms, structure or organization Of the User Platform, alter, adapt, create derivative works including translating, arranging and generally modifying all or part of the User Platform. The User is prohibited from reproducing the User Platform permanently or temporarily in whole or in part, by any means and in any form.
The User who does not respect the conditions, limits and terms of the license of use of the User Platform acknowledges exposing itself to the crime of infringement.
"iDay" brands are registered trademarks of NEXENTURE. Any representation and / or reproduction and / or partial or total exploitation of these brands, of whatever nature, is totally prohibited.
It is expressly understood that the User does not assign any intellectual property rights to NEXENTURE on the Ideas that it puts online on the User Platform.
All clauses of the GCUs are separate. If a clause is declared null or illegal, all other clauses shall remain valid and shall continue to bind the Parties.
The fact that either Party does not invoke any of the provisions of the GCU against the other shall not be interpreted as implying waiver of the right to invoke or benefit from it subsequently.
The interpretation and execution of the GCU, as well as all acts resulting therefrom, are subject exclusively to French law.
In the event of any dispute between the Parties concerning the interpretation, execution, or termination of the GCU, the Parties shall endeavour to settle it amicably. In the absence of an agreement between the Parties, the Courts of Lyons shall have sole authority.
Mapa Spontex (hereinafter "the Organizing Company") organizes an internal event with a competition entitled "iDay" which will take place on 18/12/13.
This Competition is open to all employees (CDI, fixed-term contract, alternating contract, temporary workers), hereinafter referred to as "Participant".
The file of the participants having been stopped on 18/11/10, any employee not listed in this one after the date of 18/11/10 will unfortunately not be able to participate in the competition and will therefore not be able to access the iDay platform.
Participation in this contest implies full and complete automatic acceptance of the present rules by the participant and its application by the Organizing Company.
As of 18/12/10, the ccsi-iday.com platform will be open in "pre-publishing" mode and each referenced participant will receive his identifier and password to access the platform.
The "pre-publishing" mode allows participants to post their ideas without their identities being revealed and without being able to consult the ideas of others.
As of 18/12/13, the platform goes into collaboration mode: Participants can continue to post their ideas but will also discover those of others and will be able to support them and to comment on them.
Via the platform ccsi-iday.com the participants are invited to post all their ideas for the company according to 6 mandatory themes (called "categories" in the platform).
The platform ccsi-iday.com is managed by an external service provider (Société Nexenture). Moreover, any idea that is too trivial, without an economic reality, tendentious, conflicting and / or defamatory cannot be disseminated and will therefore be excluded from the system of rewards.
There are no minimum and / or maximum number of ideas for each participant. We must first "support" an idea in order to "comment" it. Each participant can "support" only once the same idea. Participants have until 18/12/13 上午12:00 to edit their ideas. Participants have until 18/12/14 下午2:00 to post their ideas on the platform.
Management of anonymity and revelation of identity: The identity of each participant who posted an idea will be revealed from "10 supporters". The names of people who have supported an idea will never be visible to them.
The winners are appointed by a jury composed by members chosen by the Organizing Company.
The winners will be officially announced via the company's various communication media. Prizes will be awarded to winners within 6 months of the results.
The Organizing Company reserves the right, if circumstances so require, to modify, postpone, extend, suspend or cancel the contest without notice, without liability being incurred as a result. No compensation will be requested by the participants.
Participation in iDay is free.
Participants acknowledge that the ideas posted in this contest and their possible exploitation will be the exclusive property of Mapa Spontex.
Participation in this competition involves the automatic knowledge and acceptance of the characteristics but also the limits of the Internet, particularly as regards performance or technical malfunctions, the lack of protection of certain data against possible misappropriations.
The personal information collected is mandatory for taking into account the player's participation in this operation. They are intended for Mapa Spontex, responsible for processing and will be used for the smooth running of this game by the organizer of the game.
In accordance with the law n ° 78-17 «Informatique et Libertés» of January 6th, 1978, the participants will be able to oppose the treatment of the information concerning them, to accede to it, to have them rectified by writing by simple letter to the headquarters of Mapa Spontex.
